1) General

These online general terms and conditions of sale (hereinafter the “Terms and Conditions”) are adopted by LEXON S.A.S (hereinafter “LEXON”), a simplified joint-stock company with its registered office at 125 avenue des Champs-Élysées, 75008 Paris, France, registered with the Paris Trade and Companies Register under number 342 979 044.

The Terms and Conditions govern the sale of LEXON products via the online store available on the website lexon-design.com (hereinafter the “Website”). The Terms and Conditions do not apply to sales made by retailers of LEXON products.

The Terms and Conditions applicable to an order are those in force on the date the order is placed, in the version appearing on the Website on that date. When confirming your order, you will be asked to accept the Terms and Conditions. Acceptance of the Terms and Conditions is a necessary condition for the processing of your order.

LEXON reserves the right to amend the Terms and Conditions at any time, at its sole discretion. If you wish to place an order for LEXON products via the Website, we recommend that you review the Terms and Conditions as displayed on the Website before confirming your acceptance.

 

2) Buyers

Online sales via the Website are intended for end consumers of LEXON products only, and not for resellers. LEXON may, at its discretion, refuse an order if it suspects that the buyer is purchasing the products for resale purposes.

 

3) Products

The LEXON products available for purchase via the Website are those displayed on the Website on the date of your order, subject to availability.

LEXON reserves the right to modify the range of LEXON products offered for online sale at any time.

Images of LEXON products displayed on the Website are provided for illustrative purposes only and may differ from the delivered product. Product descriptions and product sheets available on the Website are provided for informational purposes only and do not constitute contractual documents.

LEXON disclaims all liability for any errors or omissions in the images displayed on the Website, as well as in the product descriptions or product sheets.

LEXON reserves the right to limit the number of LEXON products that may be purchased during a single online ordering session.

 

4) Prices

The currency displayed for LEXON product prices depends on the country selected while browsing the Website.

Prices displayed include VAT where applicable.

Product prices do not include shipping costs. These costs vary depending on the destination country and the delivery method you choose. They are detailed in Section 7 below.

LEXON reserves the right to modify product prices and shipping costs without prior notice and at its sole discretion.

The prices and shipping costs applicable to your order will be displayed on the order summary page. You will therefore be able to review them before confirming your order.

 

5) Orders

To order products via the Website, you must proceed as follows:

To purchase a product, it must first be added to your cart.

• Once you have added all the products you wish to order to your cart, you must validate your order.
• The contents of your cart will be displayed, and you may remove any products you do not wish to order.
• Once you have reviewed the contents of your cart, you must, in order to proceed with your order, accept these Terms and Conditions online by checking the corresponding box.
• You will be asked to provide personal information enabling us to process your order, namely your name, telephone number, billing address, delivery address, email address, and credit card details. If you do not yet have a customer account, you may create one at this stage.
• Once completed, the Website will display a page summarizing the ordered products and their prices, along with the applicable shipping costs based on the delivery address. You will then be asked to confirm your acceptance. Once this acceptance has been confirmed, your order will be final and may no longer be modified.
• You will then receive an order confirmation email containing the details of your order.

LEXON shall only be bound by the order upon issuance of this confirmation.

Certain Products may be available for Pre-Order. The Customer will be charged at the time of the Pre-Order and delivery will take place once the Product becomes available. The Website will specify the estimated availability timeframe for the Products.

LEXON reserves the right to refuse or cancel any order at its discretion. In particular, LEXON may refuse an order if there is a dispute with you regarding a previous order or if LEXON has reason to believe that you are not complying with these Terms and Conditions. If an order is cancelled after your credit card has been charged, the corresponding amount will be refunded to you.

 

6) Payment

The payment of products purchased via the Site is made by credit card only. The payment is effected via a secure platform according to the SSL system (Secure Socket Layers). 

LEXON accepts Visa, MasterCard, American Express credit cards and express payments via Paypal, Apple Pay and Google Pay. LEXON may accept other credit cards at its discretion but without any obligation to do so. 

Your credit card will be debited at the time of confirmation of payment. 

All holders of credit cards are subject to validation and authorization by the issuer of the card. If the issuer of your card refuses payment, LEXON will not deliver the ordered product. It will be up to you to contact directly the issuer of your card to solve the problem. LEXON declines all liability for the delay in delivery or non-delivery of the product.

 

7) Delivery Times and Terms

Delivery times and shipping costs for LEXON products vary depending on the destination country and the delivery method selected when placing the order.

• Incoterm DDP (Delivered Duty Paid) = No additional fees, taxes, or customs duties will be charged to the customer upon receipt of the parcel.
• Incoterm DAP (Delivered At Place) = The customer is solely responsible for the payment of any customs duties, taxes, or import fees upon delivery. These charges are not included in the amount paid at checkout.

LEXON reserves the right to modify shipping costs without prior notice and at its sole discretion.

Products are delivered in their original packaging, together with their accessories (cable, etc.) and user manual. A copy of the order confirmation will also be included in the parcel.

 

8) Right of Withdrawal for Residents of European Union (EU) Countries

If you reside in a Member State of the European Union, you have the right to withdraw from your purchase by sending us a notice of withdrawal within 14 days from the delivery date of the product.

You may submit your withdrawal notice by contacting our customer service department at the following email address: support@lexon-design.com

Our customer service department will send you by email a return authorization number together with a return form and will provide you with the address to which the product must be returned.

Please complete the return form by indicating the return authorization number, your order number (as shown on your order confirmation), and the return address provided by our customer service department.

The product must then be returned to us in perfect condition, in its original packaging, together with its accessories, user manual, and the duly completed return form, within 14 days from the date on which the return authorization number was issued. Any returned product that does not meet these conditions, or that is sent to an address other than the one provided when the return authorization number was issued, will be refused.

The cost of returning the product shall be borne by you.

Upon receipt of the returned product, LEXON will reimburse you by crediting your credit card with an amount corresponding to the price of the product and the initial shipping costs.

 

9) Warranty Against Defects

Despite the care taken by LEXON in checking the condition of delivered products, a product ordered via the Website may prove to be defective.

LEXON warrants to the original purchaser that the LEXON product is free from material and manufacturing defects under normal use for a period of one year from the date of purchase, except if you reside in the European Economic Area (EEA) and purchased your LEXON product within the EEA, in which case the warranty period shall be two years from the date of purchase.

You must carefully inspect the delivered product upon receipt and notify us in writing within 14 days if the product shows any visible defect, does not have the characteristics specified in the order confirmation, or if an accessory is missing. You may notify us of the defect by contacting our customer service department at the following email address: support@lexon-design.com

If a defect appears later during the warranty period, you must notify us in writing within 14 days of discovering the defect. You may do so by contacting our customer service department at the following email address: support@lexon-design.com

If you fail to notify us of a defect within the required timeframe, the product shall be deemed accepted and you will no longer be entitled to claim under the warranty.

Our customer service department will send you by email a return authorization number together with a return form and will provide you with the address to which the defective product must be returned.

Please complete the return form by indicating the return authorization number, your order number (as shown on your order confirmation), and the return address provided by our customer service department.

The defective product must then be returned to us together with the duly completed return form and, if possible, in its original packaging, with its accessories and user manual, within 14 days from the date on which the return authorization number was issued. The defective product must be returned to the address provided by our customer service department when the return authorization number was issued.

Damage to the product resulting from use that does not comply with the user manual is not covered by the warranty.

Upon receipt of the returned product, and after verifying the existence of a defect covered by the warranty, LEXON may, at its option, either send you a replacement product at its own expense or reimburse the price paid (including the initial shipping costs) by crediting your credit card.

 

10) Force Majeure

LEXON shall not be held liable if it is prevented from fulfilling an order due to a force majeure event. Force majeure events shall include any circumstances beyond the control of LEXON, including but not limited to significant business disruptions, accidents, labor disputes, delayed or defective deliveries of raw materials or semi-finished or fully manufactured products, restrictions imposed by authorities, fires, floods, or other natural disasters.

 

11) Limitation of Liability

To the extent permitted by applicable law, LEXON disclaims all liability for any direct or indirect damage caused by a LEXON product, including but not limited to data loss, loss of revenue, loss of profit, or any costs related to delayed delivery.

Despite the care taken in drafting the Website, it may contain inaccurate or incomplete information. LEXON makes no warranty regarding the completeness, accuracy, or timeliness of the information displayed on the Website.

LEXON disclaims all liability for any direct or indirect damage that may result from interruption of the Website, the occurrence of bugs hindering navigation on the Website, or any other technical issue (including the possible presence of viruses or other harmful elements).

LEXON disclaims all liability regarding the content of third-party websites accessible from the Website or linking to the Website through hyperlinks. LEXON exercises no control over the content of such external websites.

 

12) Personal Data and Privacy Policy

When creating a customer account on the Website, you will be asked to provide us with information concerning you, such as your name, telephone number, email address, billing address, delivery address, and credit card details. You undertake to provide accurate and complete information.

LEXON undertakes to process your personal data confidentially. Please refer to our Privacy Policy to learn how LEXON collects, uses, and protects your personal data.

 

13) Intellectual Property

The LEXON trademark is the property of LEXON.

The Website and its content, including texts, photographs, visuals, video animations, and software, are protected by copyright law. Any reproduction is prohibited, except for your strictly private use.

The purchase of a LEXON product does not grant you any intellectual property rights relating to such product. All intellectual property rights relating to LEXON products, including trademark rights, design rights, and copyrights, are the exclusive property of LEXON or its partners.

 

14) Mediation

In the event of a dispute between LEXON and a consumer, both parties shall endeavor to reach an amicable solution. Failing an amicable agreement, after the consumer has first submitted a written complaint to LEXON via support@lexon-design.com, the consumer may refer the matter free of charge to the consumer mediator to which LEXON belongs, namely AME CONSO, within one year from the date of the written complaint sent to the professional.

The consumer mediator may be contacted:

Online Dispute Resolution Platform: In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has established an Online Dispute Resolution platform facilitating the independent out-of-court resolution of online disputes between consumers and professionals within the European Union. 15) Offer Terms

16) Lexon x Jeff Koons Collection

The Lexon x Jeff Koons collection is subject to specific conditions depending on the country from which the products are ordered or to which they are shipped. These specific conditions shall prevail over our General Terms and Conditions of Sale whenever applicable.

All sales are final and may not be returned. Our products are signed limited-edition art pieces and carry a security hologram linked to a unique serial number. We do not offer refunds and do not accept cancellations or exchanges. If we determine that a refund is justified due to exceptional circumstances, a 5% fee will be deducted from the refund amount. All shipping costs, as well as foreign duties and taxes, are non-refundable. If you have any questions regarding your purchase, please contact us within 30 days of placing the order or within 15 days of delivery of the order.

C) Purchase for Personal Use Only

Online sales via the Website are intended solely for end consumers of LEXON x JEFF KOONS products and not for resellers. LEXON may, at its discretion, refuse an order if it suspects that the buyer is purchasing the products for resale purposes.
