1) General

The present online sales terms and conditions (hereafter the “Terms”) are adopted by LEXON (hereafter “LEXON”), S.A.S, with head office at 125 avenue des Champs Elysées 75008 Paris, France, registered at the Trade and Companies Register of Paris under number 342 979 044. 

These Terms govern the sale of LEXON x JEFF KOONS products through our global online store, accessible at https://lexon-design.com (hereafter the “Site”) , for customers located outside the European Union and the United States. By placing an order, you agree to be bound by these Terms. 

LEXON reserves the right to modify these Terms at any time. The applicable Terms are those in effect at the time of your order.

 

2) Buyers

Online sales via the Site are intended for end consumers of LEXON products, and not for resellers. LEXON may, at its discretion, refuse an order if it suspects that the buyer is purchasing the products for resale purposes.

 

3) Products

The LEXON products available for purchase via the Site are those presented on the Site on the date of your order, subject to availability.

LEXON reserves the right to modify at any time the range of LEXON products offered for online sale.

The images of LEXON products displayed on the Site are for illustrative purposes only and may differ from the delivered product. Product descriptions and information sheets available on the Site are provided for informational purposes only and do not constitute contractual documents.

LEXON declines all responsibility for any errors or omissions in the images displayed on the Site, as well as in product descriptions or information sheets.

LEXON reserves the right to limit the number of LEXON products that may be purchased in a single online order session.

 

4) Prices

The currency indicated for LEXON product prices depends on the country selected for browsing the Site.

Prices include VAT where applicable.

Product prices do not include delivery fees. These fees vary depending on the destination country and the chosen delivery method. They are detailed in Section 7 below.

LEXON reserves the right to modify product prices and delivery fees at any time without prior notice and at its discretion.

The prices and delivery fees applicable to your order will be displayed on the order summary page. You will therefore be able to review them before confirming your order.

 

5) Orders

To order products via the Site, you must proceed as follows:

• To purchase a product, it must be added to the shopping cart.
• Once you have added all the products you wish to order, you must validate the order.
• The contents of the cart will be displayed, and you may remove products you do not wish to order.
• After reviewing the cart contents, you must, in order to proceed, accept these online T&Cs by checking the corresponding box.
• You will be asked to provide personal information necessary to process your order, namely your name, phone number, billing address, delivery address, email address, and credit card details. If you do not already have a customer account, you may create one at this stage.
• Once this is done, the Site will display a summary page of the ordered products and their prices, as well as the delivery fees applicable to the delivery address. You will be asked to confirm your acceptance. Once this acceptance is confirmed, your order becomes final and can no longer be modified.
• You will then receive an order confirmation email containing the details of your order.

Only upon issuance of this confirmation is LEXON bound by the order.

Certain products may be available for pre-order. The customer will be charged at the time of pre-order, and delivery will be made when the product becomes available. The Site will specify the expected availability timeframe.

LEXON reserves the right to refuse or cancel any order at its discretion. In particular, LEXON may refuse an order if there is a dispute with you regarding a previous order or if LEXON has reason to believe that you are not complying with these T&Cs. If an order is cancelled after your credit card has been charged, the corresponding amount will be refunded.

 

6) Payment

The payment of products purchased via the Site is made by credit card only. The payment is effected via a secure platform according to the SSL system (Secure Socket Layers). 

LEXON accepts Visa, MasterCard, American Express credit cards and express payments via Paypal, Apple Pay and Google Pay. LEXON may accept other credit cards at its discretion but without any obligation to do so. 

Your credit card will be debited at the time of confirmation of payment. 

All holders of credit cards are subject to validation and authorization by the issuer of the card. If the issuer of your card refuses payment, LEXON will not deliver the ordered product. It will be up to you to contact directly the issuer of your card to solve the problem. LEXON declines all liability for the delay in delivery or non-delivery of the product.

 

7) Delivery times and terms

Delivery times and fees for LEXON products vary depending on the destination country and the delivery method selected at the time of order.

=> Delivery times indicated on the Site and in the order confirmation are provided for information purposes only. LEXON cannot be held responsible for any delay beyond these timeframes.

LEXON reserves the right to modify delivery fees at any time without prior notice and at its discretion.

For delivery terms relating to pre-orders of Lexon x Jeff Koons products, please refer to Section 15.

Products are delivered in their original packaging, along with their accessories (cables, etc.) and user manual. A copy of the order confirmation will also be included in the package.

 

8) Warranty and return policy

A product ordered via the Site may be defective, despite the care taken by LEXON to ensure the proper condition of delivered products.

LEXON guarantees to the original purchaser that the LEXON product is free from material or manufacturing defects under normal use for a period of one year from the date of purchase, unless you reside in the European Economic Area (EEA) and purchased your LEXON product within the EEA, in which case the warranty period is two years from the date of purchase.

You must carefully inspect the delivered product upon receipt and notify us in writing within 14 days if the product has a visible defect, does not match the characteristics specified in the order confirmation, or if an accessory is missing. You may notify us by contacting our customer service at: support@lexon-design.com

If a defect appears later during the warranty period, you must notify us in writing within 14 days of discovering the defect. You may do so by contacting our customer service at: support@lexon-design.com

If you fail to notify us of a defect in time, the product will be deemed accepted, and you will no longer be able to claim under the warranty.

Our customer service will send you by email a return authorization number and a return form, and will indicate the address to which the defective product must be sent back.

You are required to complete the return form by indicating the return authorization number, your order number (as shown on your order confirmation), and the return address provided by our customer service.

The defective product must then be returned with the completed return form, and if possible in its original packaging, with accessories and user manual, within 14 days from the date the return authorization number is issued. The product must be sent to the address provided by our customer service when issuing the return authorization number.

Damage resulting from improper use not in accordance with the user manual is not covered by the warranty.

Upon receipt of the returned product, after verification of the defect covered by the warranty, LEXON may, at its discretion, either send you a replacement product at its expense or refund the price paid (including initial delivery costs) by crediting your credit card.

 

9) Force majeure

LEXON incurs no liability if it is prevented from executing an order by an event of force majeure. Force majeure events are circumstances outside the control of LEXON, including in particular important disruptions affecting the company, accidents, strikes, late or defective deliveries of raw materials or semi or completely manufactured products, restrictions imposed by authorities, fire, flood or other natural disasters.

 

10) Limitation of liability

Within the limits allowed by applicable law, LEXON declines all liability for any direct or indirect damage caused by a LEXON x JEFF KOONS product, including in particular loss of data, loss of revenue, lost profits or any costs related to a delay in delivery. 

Despite the care brought to the composition of the Site, the Site may contain erroneous or incomplete information. LEXON does not guarantee the exhaustiveness, exactness or current character of the information displayed on the Site. 

LEXON declines all liability for any direct or indirect damage that may result from an interruption of the Site, from the occurrence of bugs hindering navigation on the Site or from any other technical problem (including the possible presence of virus or other harmful elements). 

LEXON declines all liability regarding the content of third-party websites accessible from the Site or pointing to the Site by means of hypertext links. LEXON does not exercise any control over the content of such external websites.

 

11) Personal data and privacy policy

When you create a client account on the site, you are asked to provide us with information on yourself, such as your name, your phone number, your email address, your billing address, your delivery address as well as your credit card details. You undertake to provide us with exact and complete information. 

LEXON undertakes to treat your personal data confidentially. We ask you to consult our privacy policy to know how LEXON collects, uses and protects your personal data.

 

12) Intellectual property

The LEXON brand is the property of LEXON.

The Site and its content, including texts, photographs, visuals, video animations, and software, are protected by copyright. Any reproduction is prohibited, except for strictly personal use.

The purchase of a LEXON product does not grant you any intellectual property rights over that product. All intellectual property rights relating to LEXON products, including trademark rights, design rights, and copyrights, remain the exclusive property of LEXON or its partners.

 

13) Applicable Law and Jurisdiction 

These Terms are governed by the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Paris, France. 

 

14) Terms of offers

French Days May 2025: Offer valid from Wednesday April 30, 2025 to Tuesday May 6, 2025 inclusive, on the entire Lexon France website, excluding products from the Lexon x Jean-Michel Basquiat and Lexon x Keith Haring collections.

This offer applies to the cart upon use of the promotional code FRENCH20, granting a 20% discount (excluding delivery fees). Offer valid while stocks last.

 

15) Lexon x Jeff Koons Collection

The Lexon x Jeff Koons collection is subject to specific terms and conditions depending on the country from which it is ordered or to which it is shipped. These special conditions override our standard terms where applicable.

B) Return policy

All sales are final and non-returnable. The products sold are limited-edition art pieces, signed, and accompanied by a security hologram linked to an individual serial number. We do not offer refunds, accept cancellations or exchanges. If we find that a refund is warranted due to exceptional circumstances, a 5% charge will be deducted from the refund. All shipping costs, as well as foreign duty and taxes, are non-refundable. If there is a concern with your purchase, please contact us within 30 days of placing the order or 15 days within the delivery of the order. 

C) Purchase for personal use only

Products may only be purchased for personal use and not for resale by buyers. You confirm that you are purchasing things for personal use only and not for resale when you place your order. We have the right to refuse orders without explanation 

During the pre-order period, no promotional codes will be valid on Lexon X Jeff Koons products.
